In reply to the discussion: Texas trooper Brian Encinia was caught fabricating his story to his supervisor [View all]Faryn Balyncd
(5,125 posts)38. Here's the video that shows him lying regarding WHEN he first told her she was
....under arrest:
At 28:09-28:16 Encinia tells his supervisor that anyone stopped at a traffic stop is "technically under arrest" and "not free to go", but falsely stated that he DID NOT SAY THE WORDS "You are under arrest".
Then, at 31:19 he falsely tells his supervisor that the point at which he told her she was "under arrest" was after he had been forced to take her to the ground because of her "resistance".
He hedged by adding words to the effect that that was his best memory.
It's pretty clear that Encinia knew that telling he she was under arrest at the time he actually did tell her "You ARE under arrest" (10:10 in this video) he had no grounds to place he under arrest (as all she had done was question his request that she put out her cigaret and tell him that she did not have to get out of her car), and Encinia knew that if falsely timed the point at which he told her she was "under arrest" to the time after he had taken her off camera and described her as "flailing her arms and kicking him" (which she clearly could not have done when she was still inside the car and he actually told her "You ARE under arrest" that he could falsely portray her arrest as legal.

OP
I'm not, the system's narrative seems to lean toward reducing departmental and civic liability

I don't know how often during their traffic stops a sgt. is aware of what communications are made.
