As long as marriage licenses are being issued, the judge will be disinclined to jail her
She'll be leaving her cell soon, under court order not to interfere with the issuance of licenses by deputy clerks
If she wants to go back to jail for contempt, she can then go back to the office and try to prevent her deputy clerks from issuing licenses
About a week and a half ago, the Rowan county attorney asked the state DA for an official misconduct prosecution
Some criminal convictions in KY do disqualify a person from holding elected office; I don't know whether class A or class B official misconduct misdemeanor convictions have this effect

You are correct that there is no bail. But she has not been tried and convicted.
