The thing about affirmative action is that one may not be able to opt out entirely (letters of recommendation may make reference), even if one wants to. What would we have him do, not apply to Yale due to his legal misgivings about their use of affirmative action? It may be difficult to find a school which did not at that time (CalTech, one of the lone non-AA institutions has never had a law school).
