There’s a big difference between doing something by accident and doing it intentionally. This is the difference between involuntary and voluntary manslaughter. Both involve causing another’s death, but manslaughter typically brings less serious penalties than murder. Involuntary Manslaughter

Involuntary manslaughter is the result of negligence, recklessness or irresponsibility. It’s not murder because you didn’t set out to commit it with malice aforethought, and it’s not voluntary manslaughter because it’s the unintended result of another action you took. If you drive recklessly and strike and kill a pedestrian, you might be aware that driving in such a way poses a risk of harm to others, but you did it anyway. This is negligence and could result in charges of involuntary manslaughter, which typically carries less serious penalties than voluntary manslaughter.

Voluntary Manslaughter

Voluntary manslaughter is more serious than involuntary manslaughter because it involves taking intentional action. It’s separated from murder by your state of mind at the time. Murder typically involves some level of premeditation or it occurs in the process of committing another felony, such as robbery. Voluntary manslaughter is instigated by situations of extreme emotion, such as if someone provokes or betrays you and you react in fury or grief. A voluntary manslaughter charge might also come about if you use deadly force to protect yourself when, in fact, you misread the situation and deadly force wasn't necessary.
