(1,673 posts)I am no lawyer and only a layperson on such legal matters but could this be a case of double jeopardy where you can not be sentenced twice for the same crime? They ready served their sentences as dictated by a state judge but a federal judge wants to increase their sentence after already serving.
Is it possible to be sentenced (and time already served) for a crime by a state jury and judge and then be overruled by a federal judge after the fact? It may be true the state judge sentenced them to serve terms that were too short by federal standards but is that not the fault of the state and or federal judicial process? An additional 4 years incarceration seems excessive when compared to the original sentences already served.
IMHO, Sounds like double jeopardy to me.
