The state from governor down stonewalled. The EPA also knew for many months and sat on it. If your agency has protection as part of its name and didn't assert itself, then they are also culpable and needs to say more than they were waiting for legal sanction instead of blowing the whistle. The Republicans want to get rid of EPA this is grist for their mill.
