(5,312 posts)40. He still won't speak at oral argument.
However, where he is in real trouble is at the post-argument conference at which justices vote and writing assignments are given. After the Chief Justice opens the discussion, the justices go around in seniority order to give their opinions. So now Thomas has to speak after only Roberts and Kennedy. Does he indeed have his own opinions and will he voice them? Will he start following Roberts? He certainly won't follow Kennedy--that's clear. Will he pass and wait for Alito to speak? Roberts is slightly less reactionary than Thomas, so this may actually have a bigger impact than just replacing Scalia. It could potentially impact Thomas' reliably reactionary vote in a better direction?
