Our country protects even "unpleasant speech" to avoid a restriction on Free Speech. The government can restrict speech if it meets a multi-part test related to the government's need for the restriction. The most famous example is "you cannot shout "Fire" in a crowded theater!"

There is video of him doing it, he admits to doing it on FB. I would bet it meets most state's statutes for assault and battery. They need to pay for their crimes like anyone else. Just think how you would feel to be in her shoes. She needs protection, has to testify, the media will probably drive her crazy. This is tough for her no matter which way this plays out.
