5. Maybe, but that's not quite the spirit of the thing

He may have done a dumb thing (assuming the claim is true), but he didn't zap himself in the process of committing the stupidity. That's the key. A retaliatory act by another person is outside of the parameters.


For instance, if I don't wear a seatbelt while four-wheeling in my Jeep, that's stupid, and if I castrated myself in the process, then that would be a Darwin. But if I get home and my pal beats me to death for my stupidity, then that's not a Darwin.

IMO, of course.
