I think Roberts and the rest of the thugs on the Supreme Court would never think of handing Obama a victory, especially in light of his criticism during the SOTU address. As a matter of personal pride I think they will resist any attempt to overturn CU. They might use the Montana case to limit CU but to overturn it or modify it in any significant way is highly unlikely, especially when their man, Mittens RMoney, is running for President.

Further just as a matter of Court jurisprudence, the court rarely re-hears or considers legal issues about which they have only recently ruled. It does happen but I seriously doubt this will be the instance. If anything I think the Rs on the Court will use this as an opportunity to not only uphold CU but perhaps even expand it.

I do not trust the conservative majority on the Court. I think they are as partisan as any candidate running for office. They definitely have their political and corporate interests in mind at all times.
