He applied for it. While he waited for a decision, he was subject to the draft (after the same student deferments everyone in America got), but they didn't get to him. Then, he aged out. It was all above board, no behind the scenes strings being pulled to keep him out of the draft without surfacing that.

Sander was 100% correct that it was an immoral war. Nuremberg principle. Muhammed Ali got props for having the courage of his convictions about that war. Bernie gets bashed for having applied for the status. Both of them were right, though.
