When filing the paperwork the Trump Foundation elected to file as a family foundation, not a public one that is allowed to solicit contributions. They could have filed as a dual foundation which can be both - they did not - but then they would have been required to submit additional proof of the activities of the foundation. There are more details and many links in the posts linked above.
