Then she can argue that the NDA was void because he never came through on his end of the agreement.

Those NDAs just blow my mind. Why would you go into ANY job having to sign some shit saying that you will NEVER say anything bad about the person hiring you? What would keep them from doing anything they possibly can to abuse you? I might see someone signing one who is starting out and absolutely desperate to the point of working or starving to death. But these people are professionals who are supposedly sought for their skills. I just don't get it!
