(46,184 posts)Whether you think the filibuster is a good thing depends on where you're sitting. Progressives hated it and wanted its use limited when it was employed to block civil rights legislation. We hated it when it was used to block Obama's nominees. We like it now that it could be used to block Trump's nominees. Not judging, just reporting.
By the way, there are constitutional scholars who have argued that the filibuster is unconstitutional. In 2012, Common Cause, along with several Democratic members of the House who had voted for the DREAM Act and DISCLOSE Act only to see it blocked by a republican filibuster in the Senate, filed a lawsuit seeking to have the filibuster declared unconstitutional. They lost when the court of appeals held the plaintiffs lacked standing (thus making it unnecessary for the court to reach the constitutional issue.)
