But you really did not answer my question. If a government entity openly uses ideology to make contracting decisions are they not opening themselves to 1st amendment complaints?

Let's say a KKK guy wins a billion dollars in the lottery, buys a radio station and then wins the bid to broadcast a major universities football games. Along with racist shit on other programs. What would be the grounds to legally deny that?

I hope it could be denied but suspect it might be hard to do. That is why I hope a lawyer chimes in.
