First, while the literal meaning of the word "treason" applies here, the legal meaning does not. There is a bit less than zero chance of anyone being charged with treason. A simple study of case law makes that absolutely clear.

"Counter intelligence" is, of course, a significant factor. Among the intelligence agencies, it is the duty of the FBI to investigate this. As they are! And that investigation is currently being conducted in the classic context of a RICO case -- which by definition involves both individuals and one or more groups.

The FBI's counter intelligence investigation will definitely identify crimes, and thus criminals.
