(60,949 posts)The closest is that the 25th amendment which has a method where the cabinet, approved by Congress can remove an incapacitated President. As a person who has never attended even one minute of a law class, but watched the Paperchase, it would seem the Constitution does not give the Supreme Court the job of determining that he is incompetent.
Not to mention, I doubt any such designation, if made, would have any retroactive effects. Obviously, the new President - presumably Pence - could simply reverse the executive orders and there may be one or two somewhere he disagrees with. However, there are a whole set of executive orders that each party almost completely agrees with and the other party disagrees with.
On the tax bill, terrible as it is - nearly every Republican in both Houses voted for their house's bill. What is clear is that ANY Republican, controlling both the House and Senate will likely pass a tax cut bill. Note that GWB passed two - the second in 2003 when we were already fighting two wars - making it the first time we cut taxes as a major war was happening.
While his reckless behavior and his lack of any diplomatic, deal making skills are things that will define his Presidency - competent or not, the tax bill and executive orders are Republican policy.
