The law does not make it illegal to be gay. It only makes it illegal for anyone to appear gay in any way.

Imagine the same thing for any other oft-discriminated-against group.

"Its not illegal to be a woman, its only illegal to appear to be female."

"Its not illegal to be Jewish, it's only illegal to appear as if you are Jewish"

As soon as you make those examples, it's obvious what the law is. The person to whom you responded can try to hide behind semantics, but honest people know what that law really means.
