5. Then how does the University have the right

to decide who can or cannot live there?

It's non-university property, like any other apartment building or a house full of renter/roommates. How does a university have jurisdiction over a private "club"?

And another question, how does an all-male club like a fraternity have any legal obligation under Title IX? Isn't that for public institutions (and co-ed)?

Maybe I should have paid more attention to this stuff when I was at a university.
