45. Well, in this case, they won't file charges

Because the person they would charge is probably also the one that got shot. But it's true that if someone else had been shot instead (like the 3 year old's older sibling), they would probably still regard it as an "accident". The best thing to do in the aftermath of an incident like this is to reinforce the notion that there are no accidents with guns.
