There have been several threads on DU about states refusing to establish exchanges. WHile I think that's a stupid decision on the part of those states, its not unlawful. The ACA is quite clear in making the establishment of exchanges by the states optional -- if the states choose not to do so, the federal government steps in and does it.
I find it emabarrassing that so many here appear to be so unfamiliar with the details of the ACA (even as many here decry the fact that the many of those in the general public who oppose ACA don't understand it)
