8. I think the article is completely misreading Kennedy.

No suprise at all that he’s going to be the deciding decider on this.

The article is intepreting Kennedy’s tougher, and more challenging questions going to the plaintiff in the case as Kennedy leaning towards deciding with the conservative wing. Historically though, this tells me Kennedy is actually leaning towards the paintiffs in the case. It’s usually his way of pushing the side to make their case.

The statements by Kennedy that gives me the most hope:

Kennedy then gave a hypothetical of his own about a local mayor who made hateful statements during his campaign and two days after he took office took actions consistent with those previous remarks.


I wouldn’t write this one off just yet.
