7. The information was not classified until after Comey shared it

Comey gave memos to a friend to be given to the press. Nothing in the memos was classified when Comey provided it. Only later parts of the memo were given the lowest security classification. Comey had zero intention to leak classified information. There is no reason to believe anyone would expect it to be classified at a later date. The odds Comey would be found guilty were there a trial are low.
