if he registered the LLC under that name, then technically he wasn't misrepresenting himself to anyone only to the state. If falls under "doing business as" cause. Then it opens it up to a different legal action that falls within the state legality.
Plenty of low budget producers file LLC's under different names especially in the porn industry.
I'm not saying it makes it legal, just that it makes it more complicated.
