The problem is the fishermen like to use floating line and long lines with buoys to the surface. They could rig buoys to rise on a sonic signal or many other solutions. I have an article somewhere on this very issue and I'll have to review it.
There is a great book on the Northern Right Whale called "The Urban Whale".
Great ruling that will probably be overturned somewhere.
