...fired it at them, then he was shot. He wasnt shot for resisting arrest.
There are some things you dont do. One of those is taking an officers equipment and firing it at them. At that point youve opened yourself up to whatever happens.

Once again, he was not DWI. He was asleep in a Wendy's drive-thru which is also private property

Had he not, resisted arrest, assaulted a police officer, stole his Taser and then fired it at them
