without the consent of Congress.

The requirement is that he must notify Congress within 48 hours of such an action, and needs to get Congressional approval if such an action exceeds 60 days plus 30 days to withdraw.

A President must have that power. As Commander in Chief he can order defensive or offensive action at a moment's notice for the simple reason that getting the approval of hundreds of legislators before any action, could leave the country defenseless if attacked, and announcing offensive actions in advance of a target would put our people in more danger.
