12. "HE NEEDS MENTAL HELP." We all need that to some extent as we all have issues.

The real question is does his issue cause him to be unaware of what he was doing and that is going to be a high hurdle to get over.
After all his use of the smoke bombs clearly demonstrate that it was planned so its unlikely that he is mentally impaired as far as his intelligence goes.
He is also clearly aware of his surroundings as evidenced by his ability to get to the subway as well as the ability to target and kill all those innocent people so it will be hard to argue he was not aware of that.
But either way its going to take a well trained professional to determine if he is fit to be put on trial.
