In his commercials he guarantees that his sheets, pillows, assorted crap will be the most comfortable you'll ever experience ever! He guarantees it! So I think once in court his defense might rely upon his using his history of hyperbole as a defense, stating this is just his way of expressing himself and trying to sell his "product" in a time honored manner. And deep down, everybody knows he's full of hogwash, and whatever he says isn't true, but that's just the way he is, plus he is so charming that people overlook his tendency to "exaggerate", and buy his products anyway.
Because you know, cancel culture (which for him even includes those dirty banksters now!) is trying to destroy him which is why his ads are full of American flags and blessings from God so his true believer customers can buy his 75% off crap and help support his struggle against... well anybody who is not a fascist, I guess!
