Fani Willis Scores Legal Win in Trump Case [View all]

Fulton County District Attorney Fani Willis scored a legal win after the judge overseeing the Georgia election interference case allowed proceedings against one of the co-defendants to move forward as former President Donald Trump and others appeal the ruling that allowed Willis to remain on the prosecution.
Judge Scott McAfee rejected co-defendant Misty Hampton's request to pause her pretrial proceedings. The move signals that the judge is prepared to continue working on some pretrial motions while a number of co-defendants litigate their appeal of his disqualification decision.
On June 5, the Georgia Court of Appeals indefinitely halted trial proceedings against Trump and other co-defendants in the case as they appeal McAfee's March decision to allow Willis to stay on the case. All co-defendants deny the charges, apart from four who have taken a plea deal. The order came two days after the court had set an October 4 hearing date to take up the matter of Willis' disqualification, and it puts the case on hold until the appeals panel ruleswhich it isn't expected to do until mid-March of next year.
"Defendant Hampton argues that the eventual appellate ruling may disqualify the District Attorney and therefore the interests of judicial economy are best served by pausing the entire case," McAfee wrote in a Monday order. "Absent complete dismissal, such an outcome will still leave a pending indictment with several statutory and constitutional challenges awaiting resolutionmany of which are fully briefed, argued, and may also benefit from appellate review," the judge continued. "At this time, the undersigned does not believe a complete stay is the most efficient course."
