2. It's advice.

Nobody's required to comply with every bit of advice that the government puts out. Even under socialism in Russia, there were things that were "advice" and often ignored. (But you had to sort out which was mandatory 'advice' and which was optional advice, then there was the 'advice' mandatory today but criminal tomorrow.)
