I.e., Congress would need to pass a law "enabling" creation of the states and the President would need to sign that and that would come with Reps. & Senators.
However since the GOP hijacked Congress, if by some draconian reason they decide to invade and take over a country/territory, they would probably leave them as "territories" like D.C., Puerto Rico, Guam, U.S. VI, etc., where they only get some cursory non-voting "Delegates" and no Senators.
