he invokes. Because of massive evidence of ICE unprovoked violence at worst, and citizens' peaceful protests, this can't be used as any exception to the Posse Comitatus Act.
The President is typically required to issue a proclamation ordering those involved to disperse.
The Act's conditions are broad, giving the President considerable discretion, though experts suggest a true emergency is necessary. Courts have generally deferred to the President's judgment on the need for the Act, but the legality of military actions once deployed can also be reviewed.
