IANAL, but in Barnes vs. Felix (2024 term), the US Supreme Court unanimously agreed that the totality of the circumstances leading to the use of force -- not just the "moment of threat" -- must be used to evaluate the reasonability of the level of force employed. This case was pretty specifically about a law enforcement officer creating the danger he then used to justify lethal force. If Ross, through his own choice of action, put himself in danger or failed to take reasonable steps (in this case, literally taking one or more steps backward) of lesser force, he probably ceded his qualified immunity.
