4. Perjury?

... the Kennedy Center board “have failed to support this assertion with any specific facts or evidence. They offer only the conclusory assertions of the Kennedy Center's Executive Director that were made in a factually unsupported declaration.”.

Is lying in this kind of filing subject to perjury charges? Can someone demand they supply evidence of their assertions or face the penalties? Why do they feel so entitled to just make shit up? Obviously I'm not a lawyer, but I really don't understand how they can do this without consequences.
