Issa's concern; about violating the First Amendment is a De Facto violation of the First Amendment, because it gives respect to religious views over the secular requirements of a large % if not over half the nation's population and by only hearing one side of the story, he prevented the people's verbal petition of Government for redress of grievances.

President Obama by requiring all insurance companies to cover birth control, was sticking to the secular aspect which is where government should be.
The only shaky ground that I can see for Obama is if he requires insurance companies used by churches to provide birth control free of charge while not requiring the rest of the insurance industry to do the same, this free coverage should be universal.
