The SCOTUS ruled that the FCC can't create a new set of regulations for ISPs. Their choices are allow "fast lanes" or stick ISPs under the old telephone rules. The old telephone rules would hurt - they're based on giving everyone crappy coverage instead of upgrading coverage.

As a result, we need new law from Congress so that the FCC can regulate ISPs as ISPs instead of regulating ISPs as phone companies.

(Whether it's better to regulate them as phone companies in the short run is hard to determine due to all the chaff being thrown about on this issue)
