Not when the person is running away and most certainly not when he's 60' away. The fastest runner in the world could not cover 60' before the officer could fire the gun, and so there was no threat. Then the witnesses said that Brown turned towards the officer and appeared to stumble, not turned and ran at the officer. There was no threat and the officer murdered this kid.
