In theory, these same two people could have met on a dating site and seen they had a lot in common, got married, had kids, and later discovered they were siblings! Then there would be no crime. So the crime isn't in the event, it's in the awareness. Unless there's a statute equivalent to involuntary manslaughter, where you could be held criminally liable for incest even though you had no intent to commit the crime ahead of time, and no awareness of having committed it at the time. Somehow I doubt there is such a statute...
