I first read of a similar case 20-30 years ago, but in that case as long as the couple agreed NOT to have children NOT a problem.
Even the Catholic Church has ruled in this regard, going back to the Middle ages, and again it is viewed as valid if no children.
What this couple wanted to do, apparently, is to EXPAND on that rule to include the right to have children, The Courts are NOT going to go that far,
