every generation of farmed food, since time immemorial, is genetically modified from the previous generation. Farmers since 10,000 BC have been modifying their crops by culling the weak ones and replanting the heartier ones. So in a sense, "genetically modified" is a meaningless term.

However, when some injects fish genes into tomatoes or creates genetic markers that do nothing by demonstrate patented genetic modifications for legal harassment of farmers, then that becomes a problem. The courts and the legislators have to create a new law that distinguishes genetic modification the "old-fashioned way" versus genetic modification that would never been able to be done without the specific knowledge of "genetics", "genome", and molecular biology.

In other words, if you can do genetic modification without anything more than a agriculture degree or less, no big deal. If you need a molecular biology degree to do genetic modification, that should be legislated.
