Should I kill a chipmunk [View all]

Firstly I am a vegetarian and love animals...

But this bugger is digging up the paver base under my patio .. I ignored it --- but its threatening the stability. He stores food inside the patio furniture ( in the winter when it is covered) ... there are droppings all over the place ... it drives me nuts..

I tried trapping it .. nothing happened .. it ate the bait though

I am thinking of killing it by making it walk the plank. killing is ILLEGAL in NJ ..as they are protected. what should I do.
