if you are two original members of the band, and you own the rights to the name of the band and its music, then you are not a tribute band.

One-half of Queen plus Adam Lambert went on tour last summer and called themselves Queen because two of them were original members and they had the rights to the name and the music. And the third guy, John Deacon, bass player, who is still alive but retired, and also owns a share of the rights to the name and the music, approved of the other two using the name and no doubt got a cut of the profits. And probably Freddie's girlfriend, who owns the rights from his estate.

Yeah, people were staying away from that tour in droves. So much so that they did over 25 dates in North America, then went to Korea and Japan, and then added Australia and New Zealand. And now they're planning on taking that same tour to Europe and South America.
