As the article explains, it's not that he's overtly a fascist, it's that his fetishism about the Constitution AS IT WAS WRITTEN OVER 200 YEARS AGO coinsides with MANY positions held by the fascists and gives them an entry into the "mainstream" of political thinking.

But it DOES lead to some "libertarian" contradictions. Also in the article, what about companies who would have the opportunity to pollute ACROSS state borders if this interpretation of the role of the Feds were adopted? Your state could have the best enviromental legislation in the whole country, but if your neighbor state has the WORST legislation, a polluting company could locate in your neighboring state and any pollution that crossed state borders wouldn't be penalized. Where is the libertarian "The rights to your fist ends at my nose" in this scenario?
