Michigan Supreme Court considers rule to bar ICE civil arrests during court proceedings [View all]


(Michigan Advance) The Michigan Supreme Court will host a public administrative hearing on Wednesday, Jan. 14 for a proposed court rule that would prohibit any civil arrests from taking place in a courthouse “while attending a court proceeding or having legal business in the courthouse.”

The rule, put forward for public comment by the court in late November, would cover most ICE arrests, usually done under civil immigration warrants — which are administrative warrants, not judicial warrants.

The proposal’s public comment period garnered a huge response, with over 2,500 comments posted to the court’s website over the course of just over a month. Most of the comments were submitted by individuals, but legal organizations such as the State Bar of Michigan Executive Committee and the Michigan State Planning Body also submitted comments in support of the proposed rule. Some elected officials also submitted comments in support, including Attorney General Dana Nessel and state Sens. Mary Cavanagh, Jeremy Moss and Stephanie Chang, all Detroit-area Democrats.

“This rule update would align Michigan with other states to ensure that individuals conducting legal business at courthouses – regardless of their citizenship status – are able to do so without the concern that they will be subsequently arrested for a matter unrelated to their business at the courthouse,” says the statement from the senators. ...................(more)
