Kennedy will be the swing vote in both the Affordable Care Act case and any decisions involving the Voting Rights Act. The opinion that I cite quotes heavily from a decision issued by Justice Kennedy and appears to be a brief aimed at Kennedy as to the constitutionality of the Voting Rights Act. Even though the author of this opinion was appointed by George W. Bush, this opinion does a great job of defending the VRA and may have some impact on Kennedy
