Both opinions - one was dated Jan. 10, Cuccinelli's last day in office - were provided to Del. Bob Marshall, a Prince William County Republican and social conservative opposed to gay rights and abortion.

Anticipating McAuliffe would behave like President Barack Obama, thinking "he can snap his fingers and abolish laws," Marshall is trying to establish a legal baseline for battles to come.

He said he believes McAuliffe already took executive action that violates state law: One of the first orders the Democratic governor signed Saturday prohibits state workforce discrimination against gay, lesbian, bisexual or transgender people.

Marshall, who helped spearhead a 2006 campaign to enshrine a gay marriage ban in the state constitution, this year has already filed HB444 to restrict same-sex couples from jointly filing state taxes.
