4. Sort of missing the point, I think

The issue is not whether of not the staffer sent the email unclassified. The issue, which seems to be uncontested, is that Clinton instructed the staffer to remove classified headings and send the message as an unclassified memo. Giving that instruction was an unlawful act, whether the staffer followed it or not and regardless of how she received the message.

I realize I'm not supposed to say anything negative about Clinton here, but saying that "Hugh Hewitt is lying" because it can't be proved how she received the message or that a staffer actually followed an instruction that Clinton admittedly issued is a bit much.

Actually, if she did receive it via nonsecure method, her instruction to "remove the identifying heading and send nonsecure" would be less of an issue. The indication that she apparently received it via a secure method and then instructed a staffer to send it via a nonsecure method makes the issue even worse, so the "unidentified official" is not doing her any favors with his statement.

Again, I'm not bashing Clinton here, I'm just pointing out the fallacy in an argument.
