for example, it wouldn't be illegal to surveil on the FARC members in Colombia. Colombia has a REAL active insurgency in the country whose stated goal is to overthrow the government (it doesn't matter who is president) and institute a marxist system.

This is very unlike the situation in Venezuela for example where there are only imaginary forces at work to overthrow the violent, brutal, corrupt, and inept government.
