does the clerk know that? Many people can't tell the difference between a real one and a toy, mostly people who are not familiar with guns. A cop would have shot him and it would be ruled justifiable.
The clerk would have no way of telling the mental capacity or intent. We and she only learned that after the fact.

The question is, what would you do based on what the clerk knew at that moment?
